Privacy Policy

www.sccid.sc.gov is a creation and a service of the South Carolina Commission on Indigent Defense (“OID”). It is operated, managed, and maintained by a long-term contract with a private company, Wingard Graphics.

Your privacy and security are our highest priority. Providing electronic access to state government and services, while maintaining privacy is a specific objective of OID’s electronic voucher program.

OID collects only the requisite information necessary to expedite the provisions of S.C. Code Sections 20-7-110 et seq., 20-7-1570 et seq., 20-7-1695(A)(2) et seq., 20-7-600 et seq. and 20-7-8705 et seq. Personal information in our possession is maintained and used in a ways that respect individual privacy. Employees are educated about the importance of protecting personal information, consumer privacy, and only authorized employees are officially granted access to personal information.

OID will not disclose personal information collected from users to private third parties unless South Carolina law requires such disclosure. Information collected from users by OID may be subject to inspection and copying by the public, unless an exemption exists. In the event there is a conflict between this Privacy Statement and a State or Federal law governing disclosure of public records, the applicable law shall control.

The Family Privacy Protection Act of 2002 prohibits persons or private entities from using personal information obtained from State agencies for commercial solicitation purposes. A person who knowingly violating this prohibition is guilty of a misdemeanor and subject to the penalties specified in S.C. Code Ann. § 30-2-50(D).

The Commission on Indigent Defense, established pursuant to S.C. Code § 17-3-300, is authorized to carry out and develop the rules, policies, procedures, and regulations and standards as it considers necessary to carry out the provisions of the article and comply with state law or regulations and the rules of the Supreme Court, including the nature and scope of services to be provided. . . . S.C. Code Ann. § 17-3-310(F)(2). Any information provided is used solely by the Commission on Indigent Defense (OID), for the stated purpose, unless one agrees in advance to additional use; e.g., if you request information on a particular matter, or if you are submitting information to be disseminated to other government agencies for a stated purpose.

OID does not share any personal information you provide with outside parties, except as explicitly acknowledged for the advancement of the online attorney voucher program. The information collected is used solely by OID to expedite and advance submitted attorney vouchers, as well as to secure confidential information and documentation from outside users. The generic information collected is for statistical purposes and used to assist OID management and further government agency operations. Unique and protected information is used to further the administrative procedures as related to the bylaws and guidelines as established by OID.

While OID reserves the right to change this policy without advance notice, a new policy will not go into effect until details have been posted here. OID also reserves the right to add features designed to elicit member information. If the firm decides to add such features, they will be clearly marked and the nature and potential use of the data collected will be explained.

All submitted information is handled in accordance with the requirements of the Privacy Act and the Freedom of Information Act to ensure the greatest protection of personal privacy in the face of any required disclosure.
